AUTOLINEE BOLDRINI WILL NEVER USE OR SELL YOUR PERSONAL DATA (I.E. EMAIL ADDRESS) TO SEND YOU ADVERTISING. COMMUNICATION IN COMPLIANCE WITH LEGISLATIVE DECREE NO. 276 OF 10 SEPTEMBER 2003. ARTICLE 9, PARAGRAPHS 2 AND 3 INFORMATION STATEMENT WHICH PERTAINS TO PERSONAL DATA SENT BY THE USER AND DATA TREATMENT AGREEMENT IN COMPLIANCE WITH ARTICLE 7 OF LEGISLATIVE DECREE NO. 196 OF 30 JUNE 2003 This agreement consists of the translation of an Italian agreement and is thus entirely governed by Italian law. INTRODUCTION Autolinee Boldrini di Boldrini & Ranfagni snc manages personnel research processes with high reliability and professionalism, in compliance with regulation. Personal data is treated by Autolinee Boldrini di Boldrini & Ranfagni snc only in order to research and select personnel, in compliance with the principles of privacy protection set forth in Legislative Decree 196/2003. 1. DATA COLLECTION Usually Autolinee Boldrini di Boldrini & Ranfagni snc collects personal data concerning the professional abilities of a Candidate, through a curriculum vitæ (c.v.) form, and guarantees same opportunities to all the Candidates. The data can be sent by the Candidate through the provided form available at the company site, www.boldrinibus.it, or by e-mail, regular mail, phone or fax, or directly delivered to the company offices. The c.v. can be sent in one of the following cases: 1) as the result of personnel research and selection announces, which can be published on newspapers or be inserted into the company web site; 2) as the result of a voluntary decision Autolinee Boldrini di Boldrini & Ranfagni snc subjects the personal data of users to all the processing operations contemplated in Legislative Decree no. 196/2003 - that is to say, data collection, storage, organisation, conservation, processing, changes, selection, extraction, comparison, use, interconnection and any and all operations useful to the supply of the requested services. Such data may also be organised in databanks or archives. Personal data will always remain inside the company. The goals of the processing of personal data are as follows. 2. GOALS OF THE PROCESSING OF PERSONAL DATA AND DATA TREATMENT AGREEMENT Collection and processing of Candidate's personal data are meant only to recruit, select, evaluate personnel for our structure. In the form, the Candidate is asked to declare that he read the information document about personal data protection and privacy, in compliace with article 13 of Legislative Decree no. 196/2003, which can be found on Autolinee Boldrini di Boldrini & Ranfagni snc web site, www.boldrinibus.it. By accepting this, in compliance with Legislative Decree no. 196/2003, the Candidate allows Autolinee Boldrini di Boldrini & Ranfagni snc to use his data, even personal one, to: a) the evaluation of the Candidate profile; b) tracing alleged offenders only where specifically required to do so and only on behalf of the competent authorities. By sending any data in reference to this information thourgh a c.v. form offered with special conditions by the company, the Candidate agrees to such information and the act of sending shall constitue the Candidate's consent to the treatment of his personal data. Without the explicit consent of the Candidate to treat his data, the c.v. will not be stored and will be destroyed. 3. DATA COLLECTION, STORAGE AND TREATMENT Autolinee Boldrini di Boldrini & Ranfagni snc reserves the right to call only Candidates who comply with necessary requirements. Any c.v. data possessed by the company, whether related to free collection or to specific statistical surveys, is stored by the company data base and treated in compliance with Legislative Decree no. 196/2003. Data is storted both in paper archive (for at least two years) and in the data base, and the security and privacy of the data is granted by the minimal means of security, in compliance with the regulation and by the procedures explained in Enclosure B, "Disciplinare tecnico in materia di misure minime di sicurezza". In particular, used programs do not allow accidental deletion, change, unauthorized access, use or treatment of data. 4. COSTUMER'S RIGHT In compliance with article 7 of Legislative Decree del 196/2003, the Candidate has the right: - to be informed of the existence of any data processing which may relate to them; - to be informed of the details of the controller and the processor; - to obtain from the controller: confirmation as to the existence of personal data, the communication thereof and of their origin, as well as the logic and purposes upon which the processing is based; - the cancellation, transformation into anonymous form or the blocking of the data processed in breach of law; - the updating, rectification and integration of the data; - to oppose, in whole or in part, for legitimate reasons, the processing of their personal data, even if related to the service requested The rights referred to personal data concerning deceased persons may be exerted from anybody who holds a legitimate interest. In the exert of the right related to article 7, the party concerned can communicate by writing, power of proxy or power of attorney. Should the Candidate consider data treatment purpose terminated, he shall send written communication about it to Autolinee Boldrini di Boldrini & Ranfagni snc, which will delete such data as soon as possible. 5.
